Trademarks

Trademarks and service marks are words, names, symbols, sounds, or colors that distinguish goods and services from those manufactured or sold by others and to indicate the source of the goods. Trademarks and service marks, unlike patents and copyrights, can be renewed forever as long as they are being used in commerce. Federal Trademark registration is applicable for both goods and/or services that are used in interstate commerce. Federal registration is not required, although registration provides notice to others of the marks’ use in commerce in the US, provides access to federal courts, provides prima-facie evidence of ownership, provides access to anti-counterfeiting statues, permits enforcement of rights, and provides a basis for foreign filing.

Federal trademark applications are $200.00 per mark per classification. Our charges for a knock out search of the trademark records of the USPTO, and a report thereon, are $300.
